Poland takes Mercosur fight to EU court

The complaint was forwarded to Luxembourg on Sunday evening, said the Deputy Foreign Minister Marcin Bosacki.

He also stressed that Poland expects the Court’s ruling to lead to a suspension of both the validity and implementation of the agreement. In his view, the current version of the deal with the Mercosur countries — Argentina, Brazil, Paraguay and Uruguay — would be harmful to both Polish and wider EU agriculture.

Warsaw is also seeking interim measures to suspend the application of the agreement pending a final ruling by the European Court of Justice. The provisional application of the Mercosur deal began on 1 May.

Agriculture Minister Stefan Krajewski also confirmed the filing on X, saying Poland was the only EU member state to take legal action against the agreement before the EU’s top court.

He said the government’s priority was to protect both farmers and consumers, stressing that Polish producers were not afraid of competition provided it took place under fair conditions and high standards. He added that the Polish farming sector could count on the government’s full support.

Agreement with Mercosur

Representatives of the European Union and Mercosur countries signed a partnership agreement with a provisional trade agreement on 17 January.

The agreement was agreed by a majority of the EU Council on 9 January, with Poland, France, Ireland, Hungary and Austria opposed. The full partnership agreement will only enter into force after ratification by all EU member states.
